I. TERMS USED:
1. Seller – UAB Ekomoto, company code: 305137155, registered address: Rudausių Sodų 6-oji g. 28, LT-10106 Vilnius, online store: www.ekomoto.lt.
2. www.ekomoto.lt – online store located at www.ekomoto.lt.
3. Buyer – 1) a legally competent natural person, i.e. a person who has reached the age of majority and whose legal capacity has not been restricted by a court; 2) a minor between the ages of fourteen and eighteen who has the consent of their parents or guardians, except in cases where they are emancipated; 3) a legal entity; 4) duly authorised representatives of all of the above persons.
4. Account – the result of the Buyer's registration in this e-shop, which creates an account that stores their personal data and order history.
5. Services – all services provided to the Buyer.
6. Cookie – a small file that is sent to the device of any person visiting this online store. This term covers not only cookies, but also the use of similar measures.
7. Password – a unique combination of letters and numbers created by the Buyer and known only to them, which is entered for the first time when registering in the online store and later when logging into the Account.
8. Browser – a programme designed to display web pages (websites) on the Internet or on a personal computer.
9. Personal data – any information relating to a natural person – the data subject – whose identity is known or can be directly or indirectly determined using data such as a personal identification number, one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
10. Personal data controller – indicate the name of your company or your first and last name if you are a natural person.
11. Privacy policy – this document, which sets out the basic rules for the collection, accumulation, processing and storage of personal data, using your domain.
12. Administrator – the person responsible for managing this online store.
13. IP address – a unique number assigned to each computer connected to the Internet, known as an Internet Protocol (IP) address. 14. Rules – the approved and valid "Rules for the Purchase and Sale of Goods in the Online Store".

II. GENERAL PROVISIONS
16. The Privacy Policy of www.ekomoto.lt sets out the basic rules for the collection, storage and processing of Personal Data when the Buyer uses the Services offered by www.ekomoto.lt.
17. The Privacy Policy is designed to protect and defend the Personal Data of www.ekomoto.lt Buyers from unlawful use. The Privacy Policy also applies to www.ekomoto.lt Accounts.
18. The Buyer is deemed to have read and understood this Privacy Policy when they express their consent to the processing of their Personal Data.
The Privacy Policy can be viewed and printed at any time at www.ekomoto.lt.
19. Buyers should note that (specify your domain) contains links to the websites of other persons, companies or organisations, and that the Seller is not responsible for the content of such websites and/or the methods they use to ensure privacy, Therefore, before submitting information about themselves, Buyers should familiarise themselves with the rules, Privacy Policy and other documents of the relevant website.
20. The Buyer may make purchases on www.ekomoto.lt after registering on www.ekomoto.lt or without registering. Buyers who have not registered are required to provide the following personal data: first name, surname, telephone number, email address, and delivery address. The Buyer is responsible for providing their personal data.
21. Persons wishing to register at www.ekomoto.lt must provide their email address and a password of their choice. An account is created during registration. The Buyer enters their own data into the Account – first name, surname, gender, date of birth, telephone number, e-mail address – and is therefore solely responsible for the accuracy of this data. The Buyer may at any time:
21.1. edit and/or complete their personal data in their Account. The Buyer is responsible for the accuracy of the edited and/or completed data;
21.2. delete/remove all of their data by logging into their account and clicking on the "Delete all my data" button.
21.3. download all their data by logging into their account and clicking on the "Download all my data" button.
III. PROCEDURE FOR THE STORAGE AND USE OF PERSONAL DATA
22. The Buyer agrees that their first name, surname, email address, telephone number and IP address www.ekomoto.lt may be processed for business analysis purposes. Accordingly, www.ekomoto.lt grants the Buyer the right to express their consent or disagreement to the processing of their first name, surname, email address, telephone number, IP address www.ekomoto.lt be processed for direct marketing purposes.
23. The Seller confirms that the Personal Data provided by the Buyer will be processed only for the purpose of properly providing the services offered to Buyers in the online store www.ekomoto.lt (including the right to participate in promotions and projects). The Seller also confirms that the Personal Data provided by the Buyer will be processed for the purposes of analysing the Seller's activities and direct marketing, if the Buyer gives and does not revoke such consent. The storage period for Personal Data used for Direct Marketing purposes is set at three calendar years from the moment such data is provided.
24. The Seller undertakes not to disclose the Buyer's Personal Data to third parties, except in the following cases:
24.1. if the Buyer has consented to the disclosure of Personal Data;
24.2. when fulfilling an order or providing other services – to the Seller's partners who provide goods delivery or other services ordered by the Buyer;
24.3. for direct marketing purposes – to the Seller's partners, www.ekomoto.lt having obtained written commitments from the Seller's partners to comply with the provisions of the Law on Legal Protection of Personal Data of the Republic of Lithuania;
24.4. to law enforcement authorities in accordance with the procedure provided for in the laws of the Republic of Lithuania;
24.5. if it is necessary to prevent criminal offences or investigate them.
25. The Buyer has the following rights:
25.1. to log in to their account and download all their data by clicking on the "Download all my data" button;
25.2. to submit a written request to the Seller to obtain information about the sources and types of Personal Data collected, the purposes for which it is processed, and the recipients to whom it has been provided at least during the last 1 (one) year. The information shall be provided to the Buyer at the e-mail address specified by him;
25.3. delete all of their data by logging into their account and clicking on the "Delete all my data" button;
25.4. by disagreeing with the Privacy Policy, refuse to have their Personal Data processed. In this case, the Buyer will not be able to purchase goods and/or services in the online store (specify your domain);
25.5. By immediately expressing their disagreement or by submitting a subsequent notification in accordance with the established procedure, they may refuse to allow their Personal Data to be processed for Direct Marketing purposes.
26. At the time of collection of the goods, the Seller, an employee of Lietuvos paštas, an employee of a courier service or an employee of a Goods collection centre, the Buyer's identity document and the Buyer's data contained therein shall be used only for the purpose of proper identification of the person.
27. By agreeing to this Privacy Policy, the Buyer agrees that their Personal Data may be used to fulfil their order, regardless of whether they order goods and/or services from www.ekomoto.lt as a seller or from Partners, including agreeing that their Personal Data will be transferred to the Seller's partners, as well as processed by the Seller or its designated data processor for the purposes of analysing order fulfilment activities.
28. The Buyer's Personal Data is transferred to European Union Member States or other foreign countries under the same conditions and in the same manner as to entities located in the Republic of Lithuania and only for the purposes set out in this Privacy Policy.
29. The Seller stores Personal Data for as long as the person uses the services of www.ekomoto.lt, except in the cases specified in this Privacy Policy. After the Account is deleted, in order to comply with the requirements of the Privacy Policy, the Buyer's Personal Data may be stored on the Personal Data Controller's server for up to twelve months from the last active action (order) of the Buyer, except in the cases specified and in cases of legitimate requests from law enforcement authorities to store it.
30. The Seller shall ensure, by means of internal organisational and technical measures, that the Personal Data provided by the Buyer to www.ekomoto.lt is protected against any unlawful actions: unlawful alteration, disclosure or destruction of Personal Data, identity theft, fraud, and that the level of protection of Personal Data complies with the requirements of the laws of the Republic of Lithuania.
31. Personal data is protected from unauthorised use and alteration. All Buyer Passwords are encrypted, and only persons authorised by the Personal Data Controller may access servers related to Personal Data, and only via a secure certificate. In addition, all www.ekomoto.lt pages that require the entry of Personal Data are executed via the https:// protocol.
32. The Buyer undertakes and is obliged to keep their www.ekomoto.lt password, login name and other data secure. The Buyer undertakes and is obliged not to disclose Personal Data about themselves or third parties to other third parties if such Personal Data of third parties becomes available to them, and to immediately inform the Seller of any violations they notice.
33. The Buyer agrees in advance that the Seller has the right to store their Personal Data on the server to the extent necessary for the specific activities carried out by www.ekomoto.lt, if the data provided by the Buyer was (i) used to carry out illegal activities or (ii) suspected of identity theft or other violations that were or will be investigated by the relevant law enforcement authorities, (iii) if the Seller has received complaints related to the relevant Buyer, or if the Seller has noticed violations of the Rules committed by the relevant Buyer, or (iv) if there are other legitimate purposes for storing Personal Data. This data shall be destroyed upon receipt of lawful instructions from law enforcement or other authorised authorities.
34. When administering www.ekomoto.lt and diagnosing possible malfunctions, the Administrator may use the IP addresses of Buyers.
IV. CORRECTION, ADDITION AND DELETION OF PERSONAL DATA
35. The Buyer grants www.ekomoto.lt the right to collect, manage, process and store the Buyer's Personal Data to the extent and for the purposes set out in the Privacy Policy and other www.ekomoto.lt documents.
36. The granting or revocation of consent to collect, manage, process and store the Buyer's Personal Data shall only be valid for the future.
37. If, after reviewing their Personal Data, the Buyer determines that the Personal Data has been collected or obtained from illegal sources, or that the Personal Data is being processed for purposes other than those for which it was provided, the Buyer has the right to contact www.ekomoto.lt by email requesting that the processing of such Personal Data be suspended. A Buyer who uses www.ekomoto.lt without registering and who receives a response from www.ekomoto.lt, in which they notice inaccuracies or errors in their Personal Data, has the right to request that their Personal Data be corrected or amended as soon as possible, but no later than within 5 (five) working days. A Buyer who uses www.ekomoto.lt after registering may correct their Personal Data themselves by logging into their Account. www.ekomoto.lt has the right to correct, supplement, delete Personal Data or suspend the processing of Personal Data only after identifying the Buyer who made the request.
38. If www.ekomoto.lt has doubts about the accuracy of the Personal Data provided by the Buyer, it may suspend the processing of the Personal Data of these Buyers, check and correct this data. Such Personal Data shall be used only to verify its accuracy.
39. To exercise the above rights, the Buyer may contact www.ekomoto.lt by email at info@ekomoto.lt.
V. COLLECTION AND STORAGE OF PERSONAL DATA
40. In order to provide the Buyer with full-fledged services of the online store www.ekomoto.lt, Cookies may be stored on the Buyer's computer (device). The Seller uses the stored information to identify the Buyer as a previous visitor to the www.ekomoto.lt online store, to store information about purchases added to the Buyer's shopping cart, and to collect and to collect statistics on the traffic of the www.ekomoto.lt online store. By confirming the Privacy Policy, the Buyer agrees to the storage of Cookies on their computer (device) as provided for in this Privacy Policy. The Buyer may revoke this consent at any time by changing their internet browser settings, but in this case, certain functions of the online store www.ekomoto.lt may not work for them.

VI. FINAL PROVISIONS
41. This Privacy Policy shall enter into force on 25 June 2019. Any changes to the Privacy Policy will be announced in point 42 of this Privacy Policy.
