E-commerce rules

The rules of UAB Ekomoto (hereinafter referred to as the Rules) are mandatory and an integral part of the purchase and sale agreement concluded between UAB Ekomoto www.ekomoto.lt (hereinafter referred to as the Supplier, e-shop, us, we) and the customer (hereinafter referred to as You, Your, you, yours) and familiarise you with the terms and conditions of purchase and sale of goods in the e-shop and establish the rights and obligations of UAB Ekomoto and you in relation to the purchase and sale of goods in the e-shop.


I. General provisions

1. The following persons are entitled to use the services of the e-shop:

   1.1. a legally competent natural person, i.e. a person who has reached the age of majority and whose legal capacity has not been restricted by a court;
   1.2. minors between the ages of fourteen and eighteen who have the consent of their parents or guardians, except in cases where they are emancipated;
1.3. legal entities;
1.4. authorised representatives of all the above persons.

2. If you wish to use the services of the online store, you must register. Registration is considered complete and valid when you submit your information electronically and proceed to the next steps.

3. The personal data you provide (name, surname, address, telephone number, e-mail address) when registering with the e-shop is stored and processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 4. The prices of goods indicated in the online store's product catalogue are valid only when purchasing these goods in the online store.

4. The prices of goods listed in the online store's product catalogue are valid only when purchasing these goods in the online store. The prices of goods in the online store include VAT. Delivery costs are not included and are indicated separately when placing an order. The delivery cost is clearly indicated to you before the order is confirmed and is specified in the order confirmation itself.

5. The purchase and sale agreement between you and www.ekomoto.lt is considered to be concluded from the moment you have created a shopping basket in the online store, specified the delivery address, selected the payment method and familiarised yourself with these Terms and Conditions (by clicking the button "I agree with the Terms") and click on the "Next step" button. The contract concluded electronically between UAB Ekomoto and you is stored in the e-shop and is available to you in electronic form.

 

II. YOUR RIGHTS AND OBLIGATIONS

7. The buyer may select and order any product from the products presented in the e-shop catalogues.

8. By using the services of the e-shop, the buyer agrees to these terms and conditions of the purchase and sale agreement and is obliged to comply with them.

9. The buyer must provide detailed and accurate information in the online store registration form. If your personal data changes and we are not informed of this, you will assume all the risk of loss arising from the timely and proper fulfilment of the order.

10. The buyer is responsible for all actions performed using the e-shop.

11. The same person is prohibited from registering and using the services provided by the online store with several different sets of data.

12. The buyer must be at the agreed location at the specified time to receive the ordered goods. If the buyer is unable to receive the ordered goods or pay for them at the agreed time due to their own fault, a one-time fee may be applied, which is calculated individually.

13. The buyer undertakes not to disclose their registration and login details to third parties. If you lose your login details, you must immediately inform UAB Ekomoto by email at info@ekomoto.lt. UAB Ekomoto is not responsible for the actions of third parties who use your login details before you notify us. In such a case, UAB Ekomoto has the right to assume that you performed the actions in the online store.

14. UAB Ekomoto is not responsible for the actions of third parties who use your banking system to conclude purchase and sale agreements using the services of the online store.

15. In order to provide you with full services on our website, we ask for your permission to store information (cookies) on your computer (device). We will use the stored information to recognise you as a previous user of the website and to collect website traffic statistics. You can view the information (cookies) we store at any time and delete some or all of the stored cookies. You also have the right to refuse to allow information (cookies) to be stored and used on your computer (device), but in this case, some website features may not be available to you. You can revoke your consent at any time by changing your internet browser settings or by contacting us using any of the contact details provided on the website.


III. Rights and obligations of UAB Ekomoto

16. If you provide false or inaccurate registration data when registering with the UAB Ekomoto e-shop, you are solely responsible for this. If UAB Ekomoto finds that the data is inaccurate/uncertain, it may delete your account and your orders will be considered cancelled until the Buyer's true and complete data is provided.

17. If it is determined that you are engaged in activities that are prohibited by the laws of the Republic of Lithuania, your account may be deleted and the Buyer may be permanently blocked from using the services of www.ekomoto.lt.

18. UAB Ekomoto undertakes to provide you with all the conditions necessary for you to use the services provided by the online store.

19. In the event of unforeseen circumstances, UAB Ekomoto, being unable to deliver the goods you have ordered, undertakes to offer you a similar product. If you refuse to accept the similar product, we will refund the money paid within 3 working days if you made an advance payment.


IV. Payment for goods

You can pay for goods:

  • In cash at the place of collection;
  • By payment card to the courier upon delivery;
  • Using online banking systems;
  • By advance bank transfer;
  • In instalments: www.ekomoto.lt or when visiting the store.


V. Delivery fee

1. Delivery fees are calculated individually, depending on the product ordered. An additional delivery surcharge of 50 euros applies in Kuršių Neringa.

2. Delivery costs are not included in the price indicated in the online store; they are specified as provided for in point 6 of the Rules.


VI. Delivery of goods

Available delivery methods

1. Once an order with delivery within Lithuania has been placed, we undertake to deliver the goods within 1-5 working days.

2. Goods can also be sent to other countries, with the cost and delivery time agreed on an individual basis.

3. Goods will be delivered by an authorised representative of UAB Ekomoto. Once you have signed the delivery note, the shipment is considered to have been delivered (delivered) properly.

4. Upon delivery of the goods, you must check the condition of the shipment together with our authorised representative.

If you notice any damage to the shipment, you must note this on the consignment note or mobile device and draw up a free-form report of damage to the shipment. Once you have signed the consignment note without any comments, the shipment is considered to have been delivered in good order. If any parts or documents (e.g., warranty card, etc.) are missing from the delivered goods, you must immediately contact us by email: info@ekomoto.lt. 

 4.1. If you do not arrive at the location specified by UAB Ekomoto to collect the goods or do not accept the order at the agreed time at the delivery address, the shipment will be stored for no longer than 2 (two) days, and the new collection or delivery time must be agreed in advance with the administration of UAB Ekomoto.

4.2. An additional delivery fee of no more than EUR 50 may apply for repeated delivery of goods.

4.3. If you are more than 10 (ten) days late in collecting the goods, UAB Ekomoto will send you a warning about its intention to terminate the purchase and sale agreement within the next 5 (five) days. If you do not respond to the warning, UAB Ekomoto will terminate the purchase agreement, deduct the delivery (if applicable) and storage costs from the amount you paid for the goods, which may not exceed EUR 150, and return the remaining amount to your specified bank account.


VII. Product warranties

27. WARRANTY TERMS

The warranty conditions apply to devices purchased from UAB EKOMOTO (hereinafter referred to as "device" or "goods" or "vehicle"). The warranty shall take effect from the date of delivery of the device, and the term is specified in Section 4 below. Free warranty repairs or replacement of defective parts under warranty shall be performed for those goods that have been paid for in full, for which the information about the goods has been clearly and correctly filled in the designated section of the user manual, and for which the purchase invoice/receipt has been retained. If the aforementioned documents are not provided, or if they contain missing or illegible information, UAB Ekomoto has the right to refuse to provide free warranty repairs or replacement of parts. When the seller replaces an item or its component within the specified warranty period, the new item or component is covered by a continuous warranty period, i.e. calculated from the date of purchase of the original product. UAB Ekomoto reserves the right to refuse to apply the warranty if the warranty conditions and/or the instructions for use of the device listed below are violated.

28. WARRANTY SERVICE RULES

  • In the event of a vehicle failure, the customer shall deliver the vehicle to the nearest warranty service representative (the list of representatives is published at www.ekomoto.lt).
  • The vehicle or its component is accepted by the seller, who draws up a goods acceptance and transfer certificate. One copy of the certificate is given to the customer.
  • If the fault is not confirmed and/or if there are faults that are not covered by warranty obligations and free service, all costs related to the transportation of the goods to the service centre (if the customer orders such a service), the diagnosis of the fault and the repair shall be paid by the customer at the following rates/prices: transportation of goods – EUR 0.50 per kilometre plus VAT (one way); inspection of the goods/fault diagnosis – EUR 30 per hour plus VAT. In the case of non-warranty repairs, the cost estimate is agreed separately with the customer.
  • During the warranty period, faults caused by the manufacturer shall be repaired within 14-21 days of the device being handed over to the warranty service or within 45 days if the part has to be imported from abroad.
  • The vehicle must be delivered to the seller in packaging that ensures safe transport. If the device is delivered without packaging, the seller is not responsible for mechanical damage caused during transport. 
  • When picking up the vehicle, the customer must check that all the parts of the vehicle delivered for repair have been returned. No claims regarding the completeness of the vehicle will be accepted later.
  • If, after the repair of the goods, the Buyer's customer (the end user of the goods) has been informed by e-mail and telephone about the possibility of collecting the goods and does not collect the goods within 5 (five) working days, a storage fee of EUR 5/day + VAT will be applied. storage fee, and if the goods are not collected within 1 month of the completion of the repair and the customer being informed by email of the repair and collection of the goods, UAB Ekomoto has the right to no longer store the goods. In such a case, the Seller shall immediately inform the Buyer in writing by email, and the Buyer shall, as soon as possible, but no later than within 5 (five) working days, organise and carry out the collection of the uncollected goods from the Seller by the Buyer's customer (the end user of the goods) to collect the uncollected goods from the Seller, assuming the further risk of storage and transfer of the goods to the customer, and shall pay UAB Ekomoto the storage fee calculated until the collection of the Goods. If the Buyer/customer fails to collect the aforementioned goods, both the customer and the Buyer lose the right to collect the goods and the Seller acquires the right to dispose of the goods at its discretion. In such a case, no compensation, remuneration or payments shall be made to the Buyer/customer.

29. WARRANTY OBLIGATIONS DO NOT APPLY IN THE FOLLOWING CASES

  • In the event of damage caused by natural disasters (lightning, flood, earthquake, fire), improper operating conditions, user intent or negligence.
  • In the event of damage caused by unauthorised, unsuitable power sources, power fluctuations, power grid malfunctions, short circuits caused by foreign objects or external influences.
  • Damage caused by objects/environmental factors entering the device: sand, liquids (corrosion, oxidation), food, water, insects, etc.
  • Failure to comply with the rules for using the device as specified in the user manual.
  • Due to the use of chemicals not intended for this purpose.
  • Damage caused after purchase due to the device being dropped, knocked, otherwise physically damaged or during transport when the device is transported by the customer.
  • Faulty repairs carried out by a service technician/person not authorised by the seller.
  • Use of the device for purposes other than those for which it is intended.
  • The device was deliberately damaged or dismantled. 
  • The battery warranty does not apply if it was stored and/or charged outdoors or indoors at sub-zero temperatures or in direct sunlight.
  • If the design of the electric scooter has been modified or the body has been altered.
  • If the speed parameters have been adjusted, the speed limiter has been removed/replaced.
  • If the scooter's electronics or related parts have been dismantled or replaced.
  • The scooter has been used for sports competitions.
  • The serial number has been damaged or erased.

 

30. WARRANTY

  • The following terms apply to all goods covered by the manufacturer's warranty:
  • The warranty for the goods is valid for 24 months from the date of delivery of the goods to the Buyer's customer (the end user of the goods - a natural person using the goods for non-commercial purposes). For the purposes of ensuring and enforcing the quality warranty for the used goods, it is established that 11 months after the transfer of the goods, but no later than within 7 days after 12 months have passed since the transfer of the goods, the Buyer (the person who purchased/owns the goods) must deliver the goods to an authorised UAB Ekomoto service centre for a mandatory inspection/check, for which, prior to the check, the Buyer (the person who purchased the goods/owner) must pay the seller a check fee of EUR 30 plus VAT, after which the warranty period for the goods (if there are no signs of improper use of the goods) continues to apply in full for the remaining warranty period. This warranty does not apply to batteries and other auxiliary components, which are subject to the following warranty terms:
  • The battery is covered by a 6-month warranty (when used in accordance with the recommendation that the battery be charged and operated within an energy range of 20 to 80% of the total battery capacity). 
  • The charger is covered by a 6-month warranty.
  • Tyres are covered by a 6-month warranty.
  • The warranty does not cover parts that are subject to rapid wear and tear, such as body parts, bearings, wheels, mudguards, protective covers or the brake system. 
  • The warranty does not cover remote controls. 
  • This warranty does not apply if the product is misused, modified, accidentally damaged, improperly stored, or damaged due to use on an unsuitable surface or due to exposure to water, cold, or other environmental factors. 
  • All costs associated with transporting the product to and from the warranty service centre shall be borne by the Buyer.

WARNING

  • Leave the device standing/stored in direct sunlight, near a heat source or devices that emit magnetic radiation.
  • Store the battery indoors or outdoors at sub-zero temperatures.
  • Use or leave the device in a damp or wet environment.
  • Deep discharge the battery without following the requirements specified in the user manual. Charge with chargers other than the original ones (supplied with the product or purchased separately from the supplier).
  • Remove covers/protective parts or otherwise disassemble the device.
  • Place heavy objects on the device.
  • Exceed the maximum user/load weight during operation.
  • Use alcohol or other chemical solvents for cleaning.

VIII. Return of goods

1. The buyer has the right to exchange purchased items (except for the list of items specified in the Retail Trade Rules, p. 17) within fourteen days at the place of purchase or another location specified by the seller.
The Retail Trade Rules (Retail Trade Rules, point 17) stipulate that the Buyer's request to exchange goods of adequate quality for similar goods or to refund the money paid may only be satisfied if the Seller agrees to the purchase of the following goods:

17.14. electrical machinery and equipment, sound recording and reproduction apparatus, and television image and sound recording and reproduction apparatus (codes according to the Combined Nomenclature – 8501–8548).
17.15. land vehicles (codes according to the Combined Nomenclature – 8701–8716).
17.17. Optical, photographic, cinematographic, measuring, checking, medical or surgical instruments and apparatus (CN codes 9001-9033).

2. You may exchange or return a quality product within 14 days only if you have not used the product and have not damaged its commercial appearance. This also means that you must keep the packaging intact and only inspect the purchased goods as you would in a physical store. You can only return used goods of good quality with the seller's consent.

3. The return period for goods purchased in a physical store begins on the day after the purchase, and for goods purchased online, on the day after receipt of the goods. The consumer is responsible for proving that the goods were returned within the specified period. 

4. If more than 14 (fourteen) days have passed since the date of delivery of the goods, the Retail Trade Rules of the Republic of Lithuania shall apply to the return of goods. 

5. When a defective item is returned, UAB Ekomoto undertakes to accept the defective item and replace it with a non-defective item. If it turns out that info@ekomoto.lt does not have a similar product, the money paid for the product will be refunded to you within 5 (five) working days from the date of delivery of the product to UAB Ekomoto.

6. The returned goods must be complete and ready for safe transport. You are responsible for ensuring that the goods are complete. If the goods are not complete, they will not be accepted for return. The buyer must return the goods to the agreed location at their own expense.

7 You have the right to cancel the purchase and sale agreement (unless it is an order based on individual needs) by notifying us in writing (by email to info@ekomoto.lt) within 14 (fourteen) days of the date of delivery of the goods.

8. In cases where you notify us of your withdrawal from the purchase and sale agreement within 14 (fourteen) days of delivery of the goods (Rule 33), goods that are in good condition and complete must be returned in the packaging in which they were delivered. The packaging should be undamaged, and the goods must be clean, properly prepared and packed for safe transport.

9. To withdraw from the purchase and sale agreement, you must notify us in writing of your withdrawal within the period specified in the Rules, using the contact addresses specified in Rule 36. You will receive confirmation of the cancellation of the contract by email to the address you have provided. If you do not receive confirmation within 1 working day, you must contact info@ekomoto.lt by telephone. After cancelling the contract, you must agree with the seller on the method of returning the Goods (all issues related to the acceptance, delivery or other transportation of the Goods to the location specified by the Seller) by telephone or email within 3 (three) working days. The buyer must return the purchased Goods at their own expense, in accordance with the requirements of the first and second sentences of points 34 and 33 of the Rules.  Upon return of a complete, high-quality item in its original packaging, the money paid for the item will be refunded within 5 (five) working days from the date of return.

10. You do not have the right to withdraw from the purchase and sale agreement if:

   10.1. You have placed an order for goods with specialised characteristics that meet your needs.


IX. Final provisions

38. UAB Ekomoto reserves the right to suspend, supplement or amend these Rules and other documents related to the Rules at its discretion, informing you thereof in the online store. Additions or amendments to the Rules shall come into force on the date of their publication, i.e. on the date they are posted on the e-shop system.

39. If you do not agree with the new version of the Rules, partial additions or amendments, you have the right to refuse them, provided that you lose the right to use the services of the online store.

40. If, after the amendment of the Rules, you continue to use the services provided by the e-shop, it shall be deemed that you agree with the new version of the Rules, partial amendments or additions.

41. All disputes regarding the implementation of these Rules shall be resolved through negotiations. If no agreement is reached within 30 (thirty) days, the disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

42. These Rules are governed by the laws of the Republic of Lithuania.
